Terms of Service
1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you (an individual user or the organization you represent) and Eyecosystems, Inc. ("Eyecosystems," "we," "us," or "our") governing your access to and use of the Eyecosystems platform, APIs, data products, and related services (collectively, the "Platform").
By accessing or using the Platform, clicking "I agree," or otherwise indicating acceptance, you affirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you are using the Platform on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
If you do not agree to these Terms, do not access or use the Platform.
2. Use of the Platform
Eligibility
You must be at least 18 years of age and legally capable of entering into contracts to use the Platform. By using the Platform you represent that you meet these requirements.
Account Registration
Certain features of the Platform require account registration. You agree to provide accurate, current, and complete information and to keep your account credentials secure. You are responsible for all activity under your account. Notify us immediately of any unauthorized account access.
Acceptable Use
You agree to use the Platform only for lawful purposes and in accordance with these Terms. You are responsible for ensuring your use of the Platform complies with all applicable federal, state, and local laws and regulations, including the Americans with Disabilities Act (ADA) and Section 508 of the Rehabilitation Act.
3. API Access
Registered users and enterprise customers may receive API keys to programmatically access Platform data. The following conditions apply to all API usage:
- API keys are non-transferable and may not be shared with third parties outside your organization without express written consent from Eyecosystems.
- You must implement reasonable security measures to prevent unauthorized use of your API keys. Report any key compromise to us immediately.
- API usage is subject to rate limits specified in your subscription plan or API documentation. We reserve the right to throttle or suspend access for usage that exceeds agreed limits or degrades Platform performance for other users.
- Automated scraping or bulk extraction of data beyond your licensed scope is prohibited.
- We reserve the right to modify, deprecate, or discontinue API endpoints with reasonable notice. We will provide at least 90 days' notice before retiring any generally available API endpoint.
4. Data License
Grant of License
Subject to your compliance with these Terms and payment of applicable fees, Eyecosystems grants you a limited, non-exclusive, non-transferable, revocable license to access and use Platform data solely for the internal business purposes described in your subscription or data access agreement.
Permitted Uses
- Incorporating accessibility data into ADA compliance audits, reports, or remediation plans for your organization or your clients
- Building or enhancing accessible navigation, routing, or compliance tooling using licensed data
- Academic and non-commercial research, subject to attribution requirements
Restrictions
- You may not resell, sublicense, or redistribute raw data to third parties without a separate data reseller agreement.
- You may not use data to create a competing accessibility data product or service.
- Derivative datasets must retain attribution to Eyecosystems and the Eye Spy Foundation verification network.
5. Prohibited Uses
You may not use the Platform to:
- Violate any applicable law, regulation, or third-party rights
- Harvest, scrape, or extract data in a manner that circumvents access controls or rate limits
- Introduce malware, viruses, or any other malicious code
- Conduct denial-of-service attacks or otherwise interfere with Platform availability
- Reverse engineer, decompile, or disassemble any portion of the Platform software
- Misrepresent your identity, affiliation, or the source of data obtained from the Platform
- Use data to discriminate against individuals with disabilities or to circumvent ADA obligations
- Access the Platform through unauthorized means, including the use of automated scripts not authorized by our API documentation
We reserve the right to immediately suspend or terminate access for any violation of these prohibitions without prior notice.
6. Intellectual Property
The Platform, including its software, design, architecture, underlying databases, and aggregated data products, is the exclusive property of Eyecosystems and its licensors, protected by U.S. and international copyright, trademark, and other intellectual property laws.
The Eyecosystems name, logo, and product names are trademarks of Eyecosystems, Inc. You may not use our trademarks without prior written consent, except as necessary to truthfully identify our products or services in non-commercial contexts.
User-submitted content (such as barrier reports, corrections, or photos contributed through the verification network) remains owned by the contributor but is licensed to Eyecosystems on a perpetual, royalty-free basis for inclusion in the Platform data layer.
7. Disclaimers
THE PLATFORM AND ALL DATA ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EYECOSYSTEMS EXPRESSLY DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Eyecosystems does not warrant that:
- Platform data is complete, accurate, current, or free of errors at any given time
- The Platform will be uninterrupted, timely, secure, or error-free
- Results obtained from the Platform will meet your specific compliance or legal requirements
Accessibility data is provided for informational purposes. You are solely responsible for conducting independent verification and for ensuring your organization's compliance with all applicable accessibility laws. Nothing in the Platform constitutes legal advice.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL EYECOSYSTEMS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE PLATFORM OR ITS DATA, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER OR RELATED TO THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO EYECOSYSTEMS IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain damages, so the above limitations may not apply to you in full.
These Terms shall be governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Duval County, Florida.

Material changes will be communicated by updating the "Last updated" date and, where appropriate, by direct notice to registered account holders. Continued use of the Platform following notice of changes constitutes acceptance of the revised Terms.
